Breaking News: Dr. Bhimrao Ambedkar – The Architect of Indian Constitution and Election Commission

Dr. Bhimrao Ramji Ambedkar, known as the key architect of the Indian Constitution, is also the one behind the creation of the Election Commission. He made an amendment in the Constituent Assembly which led to the establishment of the Election Commission. This independent body is responsible for conducting elections for the President, Vice President, Lok Sabha, state assembly, Rajya Sabha, and state legislative council.

Historical Background

On November 26, 1949, certain provisions of the Constitution, including those related to the Election Commission, came into force immediately after being adopted by the Constituent Assembly. The remaining provisions were enforced on January 26, 1950. The Election Commission officially began its operations on January 25, 1950, a day before India became a Republic.

Centralized Election Body

Prior to Dr. Ambedkar’s amendment, there was a proposal for separate election commissions for the Centre and the states. However, Dr. Ambedkar suggested a more centralized body headed by a chief election commissioner appointed by the President. The new Article 324 proposed by Dr. Ambedkar made the election machinery centralized with a single authority responsible for national and state elections.

Evolution of the Election Commission

During the first Lok Sabha elections in 1951, regional commissioners were appointed in Bombay and Patna for six months. However, this practice was discontinued later on. Currently, state chief electoral officers serve as the limbs of the Election Commission in their respective states and union territories.

Plenary Powers of the Election Commission

Article 324 of the Constitution grants the Election Commission “plenary powers” to conduct elections and prepare electoral rolls. The Commission has utilized these powers to address issues where election laws are silent. The Supreme Court has consistently upheld these powers, emphasizing that Article 324 provides a vast reservoir of authority for the Election Commission.
