Allahabad High Court Lawyers Protest Supreme Court’s Decision to Return Justice Yashwant Varma

Allahabad High Court lawyers are gearing up for an indefinite strike to show their disagreement with the Supreme Court Collegium’s choice to send back Justice Yashwant Varma. The Delhi High Court judge was removed from active duty today after a pile of burnt cash was reportedly discovered at his bungalow in the city during Holi.

Background of Justice Varma

Justice Varma previously served as an additional judge and then as a judge at the Allahabad High Court from 2014 until his transfer to Delhi in October 2021. The President of the Allahabad High Court Bar Association, Anil Tiwari, expressed his concerns about the situation. He has requested the Chief Justice not to transfer Justice Varma back to the Allahabad High Court, stating that no court should be considered a dumping ground. Tiwari also called for a review of all judgments made by Justice Varma to restore public confidence. Additionally, he urged for an inquiry by the CBI and Enforcement Directorate into the matter.

Bar Association’s Opposition

This is not the first time that the Bar Association has opposed Justice Varma’s transfer. Last week, the association made it clear that the Allahabad High Court should not be treated as a “trash bin.”

Supreme Court’s Orders

Earlier today, the Supreme Court issued orders for Justice Varma’s transfer. The proposed switch, which was suggested on March 20 after the money was discovered, will be finalized once the center approves the move. The Supreme Court clarified that the discovery of the money and the judge’s new posting are unrelated.

In-House Inquiry Panel

The Supreme Court has set up a panel, consisting of the chief justices of the Punjab and Haryana, Himachal Pradesh, and Karnataka High Courts, to conduct an in-house inquiry into the matter. This decision was made to ensure transparency and to address the controversy surrounding the judge.

Judge’s Response

Justice Varma has denied any connection between himself or his family members and the discovered money. He expressed shock over the incident and clarified that the outhouse where the money was found is separate from the main residence and accessible to anyone with permission to enter the grounds.

Transparency Measures

In an unprecedented move, a report by Delhi High Court Chief Justice DK Upadhyaya has been made public by the Supreme Court to maintain transparency in the proceedings.
